Employees who take leave for pregnancy or childbirth complications may receive up to sixteen weeks of FAMLI leave.<\/li>\n\n\n\n<li>Employers and their employees are both responsible for funding the program and may split the cost 50\/50.&nbsp; The premiums are set to 0.9% of the employee\u2019s wage with 0.45% paid by the employer and 0.45% paid by the employee.<\/li>\n\n\n\n<li>Businesses that report having ten or more employees who worked during 20 or more weeks in all of 2022 will be responsible for sending the full 0.9% premium for all four quarters of 2023.<\/li>\n\n\n\n<li>Businesses with nine or fewer employees do not have to contribute to the program but do need to remit their employee\u2019s share (0.45%) of the premium on behalf of the employees each quarter.<\/li>\n\n\n\n<li>Employers are never required to pay more than 50% of the total premium, however they may choose to cover some or all of their employees\u2019 premium as a company perk.<\/li>\n\n\n\n<li>Premiums are paid on wages up to the Federal Social Security Wage Cap ($160,200 for earnings in 2023).&nbsp;&nbsp; <\/strong>Most Colorado businesses will need to begin deducting FAMLI premiums from all employees on their payroll, including full-time, part-time, and seasonal.  The new employee and employer taxes will be made available in isolved for all companies who do business in Colorado.<\/li>\n\n\n\n<li><strong>Prior to April 30, 2023 &#8211; <\/strong>All employers, regardless of size, will be required to register with the FAMLI Division before the first premium payment is due at the end of the first quarter of 2023.&nbsp;<em><strong>Registration is now open.<\/strong>&nbsp;<\/em><\/li>\n\n\n\n<li><strong>April 30, 2023 &#8211; <\/strong>The first FAMLI premium payments are due<strong>.<\/strong>  Insperity&#8217;s Tax Team take expertly manage this process for you.<\/li>\n\n\n\n<li><strong>January 2024 &#8211; <\/strong>Benefits will become available to workers.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-green-color has-text-color\">Resources<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Colorado Department of Labor and Employment Paid Family and Medical Leave Insurance <a rel=\"noreferrer noopener\" href=\"http:\/\/famli.colorado.gov\" target=\"_blank\">(FAMLI) program<\/a><\/li>\n\n\n\n<li>The Colorado Department of Labor and Employment <a rel=\"noreferrer noopener\" href=\"https:\/\/famli.colorado.gov\/employers\/famli-toolkit-for-employers\" target=\"_blank\">FAMLI Toolkit<\/a> for employers that includes several resources to help your employees navigate the upcoming changes, including the 2023 Required Program Notice, the FAMLI Employee Handbook and more.<\/li>\n\n\n\n<li>Colorado FAMLI <a href=\"https:\/\/famli.colorado.gov\/employers\/employer-faqs\" target=\"_blank\" rel=\"noreferrer noopener\">Employer FAQs<\/a><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color\" id=\"htoc-fa\" style=\"color:#009639\">Legislation FAQ<\/h3>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>Are there any special reporting requirements for FAMLI?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Employers are required to submit wage data to the Division once a quarter. This will determine the employer\u2019s total premium payment for the quarter.  Insperity will ensure your wage data is submitted to the state as required. <\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>Can I Opt Out of FAMLI?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Only local government employees and self-employed individuals have the option to opt out of the program. The following circumstances may exempt employees from paying the employee-portion of the FAMLI deduction:<br>&nbsp;<br>Employees of the federal government cannot access the state benefit, and therefore will not see any FAMLI-related wage deductions on their pay stubs.<br>&nbsp;<br>If an individual works for an employer who has chosen to cover their employees\u2019 full portion of the contribution as an added work perk, the employee will not see any FAMLI-related wage deductions.&nbsp;<br>&nbsp;<br>Employers&nbsp;may apply to opt out of the program only if they already have a privately funded paid family leave program in place that offers benefits comparable to FAMLI. Employees for those employers also won\u2019t see any FAMLI-related wage deductions but may see other deductions depending on how the employer funds its private program.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>Can self-employed workers participate in FAMLI?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Most Colorado workers will be eligible for FAMLI benefits, including self-employed individuals and independent contractors. Participation for self-employed workers is optional.&nbsp; If you do decide to opt into FAMLI as a self-employed worker, you must agree to participate by paying premiums and reporting your income for a minimum of three years.<br><br>There is no enrollment period for self-employed workers.&nbsp;You can opt in any time and apply for leave any time once benefits become available in 2024. No action is required until then.&nbsp;<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>How and when am I required to pay premiums?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Both employers and employees will begin paying into the fund starting in January 2023 through payroll deductions. Employers need to submit to the Colorado Department of Labor and Employment both their share (if required) and their employee&#8217;s share of the premium through an online system at the end of each quarter.  Insperity will submit the premiums to the state on your behalf.<br><br>These contributions build the FAMLI fund during 2023. Starting on January 1, 2024, employees may begin to file claims to receive their FAMLI benefits through an online process in development by the Department.<br><br>The 2023 premium payment schedule is:<br><br>\u2022 <strong>April 30, 2023 <\/strong>&#8211; A 30-day grace period will be offered before the first premium payments and wage reports are considered late.&nbsp;<br>\u2022<strong> July 31, 2023<\/strong><br>\u2022 <strong>October 31, 2023<\/strong><br>\u2022 <strong>January 31, 2004<\/strong><\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>How do employees pay their portion of the benefit?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Employees will see a FAMLI wage deduction on their pay stubs. However, some employers may choose to cover their employees\u2019 portion as an added benefit.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>How do I count nationwide employers?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">National employers who have employees based all over the country will need to use their total employee headcount to determine its premium responsibility for its Colorado-based employees.<br><br>In the example below, this employer has 15 total employees and will be required to remit the full 0.9% premium (0.45% from employees and 0.45% from the employer) for the eight employees who are based in Colorado.<br><br><img loading=\"lazy\" decoding=\"async\" width=\"982\" height=\"594\" class=\"wp-image-3986\" style=\"width: 600px\" src=\"https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-national-employers.jpg\" alt=\"\" srcset=\"https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-national-employers.jpg 982w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-national-employers-300x181.jpg 300w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-national-employers-768x465.jpg 768w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-national-employers-50x30.jpg 50w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-national-employers-60x36.jpg 60w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-national-employers-100x60.jpg 100w\" sizes=\"auto, (max-width: 982px) 100vw, 982px\" \/><br><br><\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-group is-vertical is-layout-flex wp-container-core-group-is-layout-8cf370e7 wp-block-group-is-layout-flex\">\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>How do I count remote employees?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">If an employer has more than ten total employees, even if they work outside of Colorado, the employer will still be responsible for sending in the full 0.9% premium once a quarter.&nbsp;<br><br>In this example, the employer would be responsible for remitting the 0.45% employee share and the 0.45% employer share for the three employees who work in Colorado because it has 12 total employees.<br><br><img loading=\"lazy\" decoding=\"async\" width=\"988\" height=\"616\" class=\"wp-image-3914\" style=\"width: 600px\" src=\"https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-remote-ees-1.jpg\" alt=\"\" srcset=\"https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-remote-ees-1.jpg 988w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-remote-ees-1-300x187.jpg 300w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-remote-ees-1-768x479.jpg 768w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-remote-ees-1-50x31.jpg 50w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-remote-ees-1-60x37.jpg 60w, https:\/\/help.insperity.com\/hcm\/wp-content\/uploads\/sites\/2\/2022\/12\/famli-remote-ees-1-100x62.jpg 100w\" sizes=\"auto, (max-width: 988px) 100vw, 988px\" \/><\/div><\/div><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>How do I determine my employee headcount?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">The number of employees your company has will be calculated by counting the number of employees you have on your payroll for a total of 20 or more calendar workweeks in the preceding calendar year.&nbsp; Employers will report their headcount during the initial registration process and once a year thereafter during the first quarter of every year.<br><br>It\u2019s important to note that employers are responsible for deducting and remitting premiums for every employee as soon as they are hired. Employers can request a refund for premiums paid in 2023 if they get a private plan approved by the Division with an effective date on or before January 1, 2024.<\/strong><br><br>The FAMLI Division anticipates opening the application for private plan approval in the first quarter of 2023. Instructions on that application process are forthcoming. <\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>If an employee lives in Colorado but works in another state, is the employee subject to FAMLI?&nbsp; IF an employee works in Colorado but lives in another state, is the employee subject to FAMLI?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Under the FAMLI Act, most private sector employers must provide paid family and medical leave to their Colorado employees, whether through the state-run plan or through a private plan with equal or greater benefits and protections. An employee&#8217;s wages will be subject to FAMLI premiums if:<br><br>1.  The employee&#8217;s work is performed entirely within Colorado.<br>2.  The employee performs work both within and outside of Colorado, but the work performed outside of Colorado is incidental to the employee&#8217;s work within Colorado, or is temporary or transitory and consists of isolated transactions; or<br>3.  Neither the base of operations nor the place from which some part of the work is directed or controlled is not in any state in which part of the employee&#8217;s work is performed, but the employee&#8217;s individual residence is in Colorado.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>What wages are subject to FAMLI Premiums?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">The FAMLI definition of included and excluded wages mirrors the Unemployment definition of included and excluded wages. Employers who are exempt from paying unemployment premiums are NOT exempt from paying FAMLI premiums.&nbsp;<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>Who is eligible for FAMLI leave?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Most Colorado employees become eligible to take paid leave after they have earned at least $2,500 in wages within the State, over a period of a year.&nbsp;<\/div><\/div><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#004c97\">Colorado Paid Family and Medical Leave in isolved<\/h2>\n\n\n\n<h3 class=\"wp-block-heading has-text-color\" style=\"color:#009639\">Implementing FAMLI deductions<\/h3>\n\n\n\n<p>Effective 1\/1\/2023, the system will automatically add the <strong>CO \u2013 CO Paid Family and Medical Leave Employee and Employer<\/strong> to each legal company doing business in the state of Colorado. The rates will automatically be added and cannot be edited. Therefore, if an employee receives Gross Wages of $8250.01, it would be multiplied by .9% and then divided appropriately between the employer and employee. Therefore, your Insperity Payroll Specialist will change the <strong>Tax Status<\/strong> for both the employee and employer portion to block the tax from calculating.
