In some situations, they may be able to take up to two more weeks, for a total of 14 weeks.&nbsp; Paid Leave Oregon covers three kinds of paid leave: Family, Medical, and Safe Leave.<\/li>\n\n\n\n<li>The contribution rate for 2023 is 1% of gross wages up to $132,900.<\/li>\n\n\n\n<li>Employers and employees share the costs, which means you will pay 40% of the contribution and your employees will pay 60%.  Your employees will participate in the program, no matter the size of your business.<\/li>\n\n\n\n<li>Small Employers, businesses with fewer than 25 employees, do not have to contribute to the program but do need to collect and remit their employee\u2019s 60% contribution.<\/li>\n\n\n\n<li>Individuals who work full-time, seasonal, or part-time jobs, and those who work for more than one employer, will pay into the program.<\/li>\n\n\n\n<li>If an employer forgot to deduct employee contributions, they can retroactively deduct the contributions from the employee\u2019s pay within the first quarter of noticing the mistake. <\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color\" style=\"color:#009639\">Important Dates<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>January 1, 2023<\/strong> \u2013 Date by which employers are required to notify their employees about the Paid Leave Oregon program.<\/li>\n\n\n\n<li><strong><strong>January 3, 2023 \u2013 <\/strong><\/strong>Pay date for which Paid Leave Oregon contributions begin<\/li>\n\n\n\n<li><strong>September 3, 2023 &#8211; <\/strong>Benefits will become available to workers.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-green-color has-text-color\">Resources<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Oregon.gov <a href=\"http:\/\/Paidleave.oregon.gov\" target=\"_blank\" rel=\"noreferrer noopener\">Paid Leave Oregon<\/a><\/li>\n\n\n\n<li>Oregon.gov has an <a rel=\"noreferrer noopener\" href=\"https:\/\/paidleave.oregon.gov\/employers\/Pages\/Toolkit.aspx\" target=\"_blank\">Employer Toolkit<\/a> that includes several resources to help your employees navigate the upcoming changes, tools to give your employees, and more.<\/li>\n\n\n\n<li>Paid Leave Oregon <a rel=\"noreferrer noopener\" href=\"https:\/\/famli.colorado.gov\/employers\/employer-faqs\" target=\"_blank\">Employer <\/a><a rel=\"noreferrer noopener\" href=\"https:\/\/paidleave.oregon.gov\/employers\/Pages\/frequently-asked-questions.aspx\" target=\"_blank\">FAQ<\/a><a rel=\"noreferrer noopener\" href=\"https:\/\/famli.colorado.gov\/employers\/employer-faqs\" target=\"_blank\">s<\/a><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color\" id=\"htoc-fa\" style=\"color:#009639\">Legislation FAQ<\/h3>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>As an employer am I subject to Paid Leave Oregon?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">If you have at least 25 active employees, regardless of where they work, and at least 1 work location in Oregon, you are subject to this tax.&nbsp; However, the Paid Leave Oregon taxes only apply to employees working in Oregon.<br><br>The size of the business is based on an average headcount of employees working in and outside of Oregon (part-time and full-time employees). This number doesn\u2019t include any employees hired to temporarily replace eligible employees when they take paid leave.<br><br><strong>Example<\/strong>:&nbsp; An Oregon company has three employees working in Oregon, 21 employees working in Idaho, and four working in Arizona. Because the company has 25 or more employees, they are subject to the employer contribution of 40% of the contribution rate. However, they will only pay the employer contribution on the three employee\u2019s wages that work in Oregon.<br><\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>Can employees opt-out of contributing to Paid Leave Oregon?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">No, employees cannot opt-out of contributing to Paid Leave Oregon.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>Can self-employed workers participate in Paid Leave Oregon?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">If you are self-employed or an independent contractor, you\u2019re not automatically covered by Paid Leave Oregon. This means you are not required to pay into the program, and you do not get the benefits. However, you can participate by choosing coverage. If you choose coverage, you will pay into the program the same way as employees \u2014 60% of the contribution rate. Self-employed individuals can choose coverage beginning Jan. 1, 2023 and can apply for leave beginning Sept. 3, 2023.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>Do Seasonal employees make contributions to Paid Leave Oregon?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Yes, all employees will contribute to Paid Leave Oregon regardless of their employment status.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>Do employees who work remotely full-time outside of Oregon contribute to Paid Leave Oregon?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">No, employees who work full-time outside of Oregon do not contribute to Paid Leave Oregon and are not eligible to receive benefits.&nbsp; In this scenario, the employee should not be assigned to an Oregon Work Location in isolved People Cloud.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>How do I configure employees with hybrid schedules within isolved?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\"><strong>Employees who have a hybrid schedule and who have a set schedule<\/strong> (routine) for days worked both within and outside of Oregon will contribute to Paid Leave Oregon on all wages earned in and outside of Oregon.<br><strong>Example<\/strong>:&nbsp; An employee has a hybrid schedule and routinely works remotely two or three days a week outside of Oregon.<br><br><strong>Employees who have a hybrid schedule and whose work <em>within<\/em> Oregon is intermittent and irregular<\/strong> (temporary, transitory, or isolated in nature) will not contribute to Paid Leave Oregon on any of the wages.<br><strong>Example:&nbsp;<\/strong> An employee has a hybrid schedule and works mainly from outside of Oregon and occasionally works in Oregon.<br><br><strong>Employees who have a hybrid schedule and whose work <em>outsid<\/em>e of Oregon is<\/strong> <strong>intermittent and irregular<\/strong> (temporary, transitory, or isolated in nature) will contribute to Paid Leave Oregon on all wages earned in and outside of Oregon.<br><strong>Example:<\/strong>&nbsp; An employee has a hybrid schedule and works mainly within Oregon but occasionally works in Idaho.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-group is-vertical is-layout-flex wp-container-core-group-is-layout-8cf370e7 wp-block-group-is-layout-flex\">\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>How do employees pay their portion of the benefit?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Employees will see a Paid Leave Oregon wage deduction on their check.<\/div><\/div><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>I already offer Paid Family Leave; do I have to participate?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">If you already offer Paid Family Leave,&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/paidleave.oregon.gov\/employers\/Pages\/equivalent-plan.aspx\" target=\"_blank\">you may be able to apply to use your own plan\u200b<\/a>. Your plan must offer at least the same benefits as Paid Leave Oregon. <strong>You first need to get it approved by the Oregon Employment Department.<\/strong><\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>I am an employer in a different state who has a remote worker who lives and works in Oregon. Does my business have to participate?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">It depends. Paid Leave Oregon uses the same localization standards as the federal unemployment insurance program and Washington Paid Leave program. Employers who have employees working and living in Oregon will likely need to participate in Paid Leave Oregon by collecting the employee\u2019s share of the contributions.<br><br>If an employer has 25 or more employees, they must pay the employer&#8217;s share of the contribution for employees who earn wages in Oregon. If an employer has fewer than 25 employees, the employer is not required to pay the employer&#8217;s share of the contribution for employees who earn wages in Oregon. However, employees working and living in Oregon would still pay the employee contribution.<br><br>Oregon residents who physically do all their work in another state do not pay contributions for Paid Leave Oregon and are not eligible for the program.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>What are the reporting requirements for Paid Leave Oregon contributions?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Insperity will file quarterly on your behalf using the updated <em>Form OQ, Oregon Quarterly Tax Report.<\/em><br><br>The Oregon quarterly tax forms will automatically be updated to show all wages eligible for contributions under Paid Leave Oregon, the employee count, and contributions due.&nbsp; Insperity will also file a <em>Form 132, Oregon Employee Detail Report<\/em> that includes paid leave subject wages. <em>Form OQ<\/em> and <em>Form 132<\/em> together make up the <em>Oregon Combined Payroll Tax Report<\/em>. The <em>Oregon Combined Payroll Tax Report<\/em> is due on or before the last day of the month following the close of the calendar quarter.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>What if my business is in a state, like Washington, that already has a Paid Leave program?&nbsp; Do I have to participate in this one as well?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">It depends on where each employee in your business works. Paid Leave Oregon uses the same localization standards as the federal unemployment insurance program and Washington Paid Leave program.<br><br>You will likely not need to contribute to two states for the same employee. If your employee works primarily in Oregon, you will collect employee contributions and pay employer contributions into Paid Leave Oregon on all wages earned in Washington and Oregon.<br><br><strong>The State of Oregon Employment Department is working with Washington to make sure they both follow the same rules for contributions, so employees do not have to pay twice.<\/strong><\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>What if some of my employees are based in Oregon and others are out of state?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Employer contributions are based on total employer size. This includes the number of employees working within Oregon and those outside the state. If an employer has 25 or more employees, they must pay the employer&#8217;s share of the contribution rate for employees who earn wages in Oregon. Here\u2019s what you need to know:<br><br>\u2022 As a small employer, you are not required to pay the employer portion of Paid Leave Oregon contributions, but you will still need to submit your employees\u2019 portions.<br>\u2022 Even though you do not make payments, your employees are still covered and get the same benefits.<br>\u2022 Payments are still taken from their paychecks, and you\u2019ll still collect and submit them.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>What is the account number for this tax?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Insperity will use your Business Identification Number (BIN) for reporting, paying, or asking questions about your Paid Leave Oregon account.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>What is the schedule for when contributions are collected?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">The Paid Leave Oregon program will be part of the Oregon Combined Quarterly Tax Report schedule.&nbsp;<br>&nbsp;<br>Paid Leave Oregon contributions will begin with your January 3, 2023 pay date which may include a pay period that began in December 2022.&nbsp; The employer of the contribution will be impounded with the rest of your tax obligations.&nbsp; Review the tax section of the Payroll Summary for details.<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>What wages are subject to Paid Leave Oregon Premiums?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">The way Paid Leave Oregon defines wages is very similar to how Unemployment Insurance defines it.&nbsp; <strong>There may be some exceptions to how \u201cwages\u201d are defined. Oregon is working with Unemployment Insurance to make it clear as possible and help support employers.<\/strong><br><br>Wages for Paid Leave Oregon include:<br><br>\u2022 Salaries and hourly pay<br>\u2022 Piece rate and by the job pay<br>\u2022 Vacation, sick, and holiday pay, and paid time off (PTO)<br>\u2022 Bonuses, fees, and prizes from an employer<br>\u2022 Compensatory time and stand by pay<br>\u2022 Commission or guaranteed wage payments<br>\u2022 Sickness and accident disability payments<br>\u2022 Dividends and distributions for services<br>\u2022 Tips and gratuities<br>\u2022 Dismissal and separation allowance<br>\u2022 Compensation other than cash, such as room and board (except for agricultural and domestic employees)<br>\u2022 Fringe benefits, such as company vehicles, company paid parking, sick pay by third parties (e.g., insurance companies), and dependent care<\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-ht-blocks-toggle wp-block-hb-toggle\"><div class=\"wp-block-hb-toggle__title\"><span>Who is eligible for Paid Leave Oregon?<\/span><\/div><div class=\"wp-block-hb-toggle__content\"><div class=\"wp-block-hb-toggle__contentwrap\">Most employees working in Oregon are covered by Paid Leave Oregon. Here\u2019s what you need to know.<br><br>You are automatically covered if:<br><br>\u2022 You work in Oregon; and<br>\u2022 You earned at least $1,000 the year before you apply for benefits; and<br>\u2022 You have a life event that qualifies you<br><br>This means that&nbsp;if you work a seasonal, full-time, or&nbsp;part-time job in Oregon, or for one or more&nbsp;employers, you may qualify.&nbsp;&nbsp;Many employees will get 100% of their wages replaced. Your benefit amount is based on your average wage in the previous year.<\/div><\/div><\/div>\n\n\n\n<h2 class=\"wp-block-heading has-text-color\" style=\"color:#004c97\">Paid Leave Oregon in isolved People Cloud<\/h2>\n\n\n\n<h3 class=\"wp-block-heading has-text-color\" style=\"color:#009639\">Implementing Paid Leave Oregon deductions<\/h3>\n\n\n\n<p>Effective 1\/1\/2023, the system will automatically add the <strong>OR \u2013 OR Paid Family and Medical Leave Employee and Employer<\/strong> to each legal company doing business in the state of Oregon. The rates will automatically be added and cannot be edited. Therefore, if an employee receives Gross Wages of $3,000.00, it would be multiplied by .6% and then divided appropriately between the employer and employee. Therefore, your Insperity Payroll Specialist will change the <strong>Tax Status<\/strong> for both the employee and employer portion to block the tax from calculating.
